Ozette Technologies, Inc. (“Ozette,” “we,” “us,” or “our”) provides this Privacy Policy (the “Policy”) to describe our practices regarding the collection, use, and disclosure of information about you. This Policy applies to the information we collect about you through our website and other online services on which we post this Policy (collectively, the “Site”) and through other methods, such as when we collect information about you through offline means (such as at a conference) or from other parties, or in the course of administering our services to our customers (collectively with the Site, the “Services”). By providing us with information, accessing, or otherwise using our Services, you agree to our collection, disclosure, and use of information about you as described in this Policy.

This Policy does not apply to information we collect about employees, job applicants, and independent contractors. This Policy also does not apply to information that we process on behalf of our customers. We do not control how our customers use or otherwise process information we process on their behalf, and you should consult with the applicable customer to understand how they use information they receive from Ozette.

1. What Kinds of Information Does Ozette Collect?

We may collect information about you on or through our Services. We collect information directly from you, automatically when you access our Services, and from unaffiliated parties.

  • Information You Provide to Us Directly
    We collect information about you when you voluntarily submit it directly to us, such as when you access or use our Services or otherwise provide us information, such as when you contact us by email or phone. The types of information we collect directly from you may include name, job title, email address, telephone number, employer name, marketing preferences, and other information you may provide us. If you choose not to provide certain information, we may not be able to respond to certain of your requests.
  • Automatically Collected Information
    When you use our Site, we and our vendors (who are other parties that perform services on our behalf) automatically collect certain information about your device and how you use the Site. The information collected may include your IP address, browser type, browser language, operating system, the state or country from which you accessed the Site, software and hardware attributes (including device IDs), referring and exit pages and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time you used the Site, error logs, and other similar information. We may be able to infer a general location from your IP address.

    To collect this information, we and our vendors may use “cookies” or similar tools that track, measure, and analyze the behaviors and usage patterns of our users. For example, we may collect information about you from LinkedIn if you communicate with us on that platform. We may also collect information about you from others. For example, users may provide us with information about colleagues or other prospective customers. We may combine information that we collect from you through the Services or elsewhere with information that we obtain from other parties and information derived from other products or services we provide.
 

2. How Does Ozette Use the Information We Collect About You?
We may use information about you for various purposes, depending on the types of information we have collected from and about you, including to:

  • Maintain, operate, provide, and improve the Services and other products and services we may offer;
  • Respond to your requests for information, including your requests for customer support;
  • Personalize your experience on the Services; 
  • Internally analyze our Services and other products and services we may offer;
  • Provide you with newsletters, advertisements, and other promotional communications;
  • Detect fraudulent use, potential fraudulent use, and otherwise maintain the security of the Services;

We may aggregate and/or de-identify any information we collect on the Services and elsewhere so that such information can no longer be linked to you or your device. We may use de-identified or aggregated information for any purpose, including without limitation for research, benchmarking, and marketing purposes, and may also disclose such data to any third parties, including marketing partners and the public.

You can unsubscribe from marketing emails by following the directions in those emails. Please note that if you unsubscribe from marketing emails, we may still send you administrative emails regarding our products and services, including, for example, notices of updates to our Terms of Service or this Policy.

3. In What Circumstances Might We Disclose the Information We Collect About You?

We may disclose your information with the following categories of recipients:

Affiliates and subsidiaries. We may disclose the information we collect to our subsidiaries or other affiliates.

Vendors. We may disclose your information to vendors that perform services for us, which may include hosting providers, mailing or email services, legal services, payments processing, data enhancement services, security, fraud prevention, or analytics services.

Otherwise with Your Consent or at Your Direction. In addition to the disclosures described in this Policy, we may disclose information about you to other parties whenever you consent to or direct such disclosures. 

3. Residents of the European Economic Area and United Kingdom

Ozette is considered the “data controller” of the “personal data” (as defined under the General Data Protection Regulation) we handle under this Policy. In other words, Ozette is responsible for deciding how to collect, use, and disclose personal data, subject to applicable law. The laws of the European Economic Area and the United Kingdom require data controllers to tell you about the legal ground that they rely on for using, sharing, or disclosing your personal data. To the extent those laws apply, our legal grounds are as follows:

  • Contractual Commitments: We may use, share, or disclose personal data to honor our contractual commitments to you. For example, we will process your personal data to comply with our agreements with you, and to honor our commitments in any contracts that we have with you.
  • With Your Consent: Where required by law, and in some other cases, we use, share, or disclose personal data on the basis of your consent.
  • Legitimate Interests: In many cases, we use, share, or disclose personal data on the ground that it furthers our legitimate business interests in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals, such as customer service, analyzing and improving our business, providing security for the Services and our products and services, preventing fraud, and managing legal issues.
  • Legal Compliance: We need to use and disclose personal data in certain ways to comply with our legal obligations.

Residents of the European Economic Area and United Kingdom may also have certain rights to their personal data. For example, you may request that we:

  • Provide access to and/or a copy of certain information we hold about you;
  • Prevent the processing of your information for direct marketing purposes (including any direct marketing processing based on profiling);
  • Update information which is out of date or incorrect;
  • Delete certain information that we are holding about you;

Please note that certain information may be exempt from such requests under applicable law. For example, we may retain certain information for legal compliance and to secure the Services. We may need certain information to provide the Services to you; if you ask us to delete it, you may no longer be able to use the Services.

In addition to those rights described herein, you have the right to lodge a complaint with the relevant supervisory authority. However, we encourage you to contact us first, and we will do our very best to resolve your concern. To protect your privacy and security, we take reasonable steps to verify your identity and requests before granting such requests. If we are unable to verify your identity, we may be unable to respond to your requests.

4. California Do-Not-Track Disclosure

Some browsers have a “do not track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, our Site does not respond to browsers’ “DNT” signals.

5. Security of the Information We Collect About You

We implement a variety of technical and organizational measures to protect your information against accidental or unlawful access, destruction, loss, misuse, change or damage. However, no Internet or email transmission is ever fully secure or error-free. Please keep this in mind when disclosing any information to us.

6. How Long We Retain Information We Collect About You

We retain the information we collect about you for as long as necessary to fulfill the purposes of the collection or for legal obligations as set forth in this Policy. These purposes may include to comply with reporting, legal and accounting obligations.

7. Information From Children

The Services are not intended for minors under 16. If we discover that an individual under 16 has provided us with information, we will delete the information to the extent required by the Children’s Online Privacy Protection Act or other applicable law.

8. Third Party Websites and Services

The Services may contain links to third-party websites or services, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on those third party websites. We recommend that you review the privacy policies posted on any platform or websites that you may access through our Services.

9. Consent to Transfer

Information collected from you, including via our Services, will be transferred to the United States where the Services are hosted. You hereby consent to the transfer of information about you to the United States as described in this Policy. Please do not use the Services if you do not agree to the transfer and processing of information about you in the United States, which may not provide the same level of protection for your data as your home country.

10. Changes to this Privacy Policy

We will review and update this Policy periodically. We will notify you of material changes in accordance with applicable law. By continuing to use the Services, you acknowledge the applicability of the updated Policy. If you disagree with any changes and do not wish your information to be subject to a revised Policy, you will need to stop accessing or otherwise using the Services.
